JOHN MCDUFF: Litigation becomes controversial when one is accused of unethical behavior, ones character is attacked, ones integrity is put into issue. Those are cases where there's more at stake than just money.
I represent people who have been victimized by unethical behavior. I also represent those who are accused. In business litigation, the issue is always the money, or at least it should be. In controversial litigation, my client has his reputation at stake. In that circumstance, you have to deal with both issues at the same time.
In addition to being objective, it's very important that the lawyer be able to be aggressive about reputation issues and hopefully bring the other party to the table where they have something at stake as well.
